As HOA president, please accept my sincere apology for no updated posts.<br /><br />I do wish to thank the other directors, including Amy Baird, Scott Hawker, Greg Kearl and Carol Sparks. All have continued their duties and covered for me as I continue heavy work travel assignments.<br /><br /><strong>Snow Removal Services</strong><br /><br />Well, a whole year has passed since earlier posts and I do wish to state that we have continued with our snow removal vendor, Great Western. We have an arrangement to withhold final payment until the property is surveyed and a damage assessment provided them. Please help us in reporting any personal property damage to grass and sprinklers. If a utility box is damaged, contact Rocky Mountain Power. They have been on site replacing boxes as necessary and it is no charge to the homeowner.<br /><br />We'll make Great Western aware of damage to the utility boxes, along with the assessment report. The vendor did not stake utility boxes this season and this cannot happen again.<br /><br /><strong>Follow Up on Swale Project</strong><br /><strong></strong><br />The Board wishes to extend another huge thanks to all the volunteers that came out in the Fall to work on our temporary fix to the swale that lines the South end of our property. Your efforts prevented the flooding of several properties that had, year-after-year, suffered water damage. The key was putting down a rubber liner that prevented water from seeping into the ground and adding to the water table underneath the homes that back to the south hill.<br /><br />The Board acknowledges that neighborhood efforts were only a temporary fix based on an engineering report that we had followed. You've all noticed the sandbags on the retaining wall and exposed liner and pipe. Please note that this is not an ongoing answer to drainage maintenance.<br /><br />Efforts are already underway to bid for contracting for the removal of the sandbags, adding and placing matching retainer wall cement blocks (for securing the liner), trenching the swale as necessary to ensure negative grade, and delivering/placing tons of gravel/rocks to protect the liner and improve the appearance (especially in the area where the water deposits to the street).<br /><br />The Board is also pursuing help from the City in the form of labor and materials. We may also reach out for additional volunteering as necessary.<br /><br />We anticipate the completion of this project by mid Summer.<br /><br /><strong>Landscaping Vendor: Hans Olsen</strong><br /><br />The Board unanimously voted to have Hans continue as our landscaping vendor. Many homeowners have expressed their appreciation for his attention to detail and extra care for our property. Hans has offered additional services, including backyard mowing, sprinkler repair, fertilization, and aeration. The Board has applied current payments to current assessments permitting the owner to gradually pay down the arrears balance with the excess. It should be noted that even though our CC&Rs state that the payments go “first to costs (such as legal), then to interest (which we do not charge), then to late fees, then to assessments,” we have applied the fees first to assessments and let the owners pay off the past due amounts as they are able.<br /><br />Each owner who has had a past due balance who has contacted the Board has had a plan worked out to help them get their arrears paid off gradually on a case-by-case basis. However this has been very slow and some homes are not paying arrears at all.<br /><br />The Board has reviewed the budget for 2009 and since there are now no reserves because they were spent on excess snow removal charges from last year, and because we cannot operate without funds, we must establish a new policy to replenish reserves and operate the HOA. We do not want to have to raise everyone’s dues because of people not paying their HOA bill, which includes arrears and penalty.<br /><br />NEW POLICY:<br />All homeowners with a past due balance of late fees, assessments, legal fees or other fines or charges must have these paid in full, with a zero balance by June 1, 2009. That is six months from now and will be enforced. Any home at that time that has a balance will have services stopped within 10 days of that date, and all measures including lien, suit, collection agency and/or foreclosure will be effected as per CC&Rs and state statutes. <br /><br />After June 1, 2009 the CC&Rs will be strictly enforced with regard to collections including:<br /> • Non-waivable $20 late fee on the 10th<br /> • Cessation of services at 10 days late including removal of trash can<br /> • “Intent to lien” letter at 30 days late<br /> • Lien at 60 days late filed against property with Utah County<br /> • Legal action/suit at 90 days.<br /><br />All associated fees for collection and legal services will be charged to the homeowner as well. SEE YOUR STATEMENT SENT TO YOU OR CONTACT THE TREASURER.<br /><br />Please review any past due balance you may have, plan accordingly to pay this off by June 1st and let the Treasurer know your intent. They waited for me to back the Pacifica out so they could shovel that side of the driveway. Where else can we find that level of customer service? "<br /><br />"Our neighborhood requires extra attention because there are very few places to pile the snow up. If the city were to come through and skim the surface instead of Darren then the homeowners would be left with a one lane road because the snow would be piled everywhere. Only one lane was clear going down the mountain, the other 3 lanes were snow covered."<br /><br />And more... "I am sure Jason's wife appreciated her driveway and road plowed to get the kids safely to bus stop. Robin's teenagers to safely make it to school while she isn't home to take them. I left down the hill to a clear Traverse Ridge road. When I came back up at 9pm the road was covered in snow again up the mountain. It was ascertained that due to poor compaction around the two manholes and two storm drains the earth had loosened and settled. The pipes may seep a bit as well. The filler we added will hold the road well and in the Spring we will investigate underground more thoroughly.<br /><br />The orange barrel will be removed.<br /><br />You will also notice there are nice tidy asphalt patches on the road as well. Behind the scenes we are working hard on some projects to make things better, and also to correct a lot of problems that many of you might not be aware of.<br /><br />• PLAYGROUND We have been working on putting a playground in for our children. We have been in ongoing discussion with SunCrest to make sure safety is considered but budget and aesthetics as well. That includes using a galvanized steel set, and shielding the park from view with raised berm landscaping treed with Aspen. If we can get some kind of approval from SunCrest then it will be put up to the residents for a vote. We want to give everyone the opportunity to vote on, make suggestions for, and make voluntary donations towards this project.<br /><br />• LEGAL STATUS OF THE HOA We had a couple of residents questioning the legality of the status of our sub-association. Scott Hawker of Alpine Homes provided a comprehensive summary of all legal documents and had them reviewed by attorneys to make sure it was all recorded correctly. Secretary Robin has all the paperwork to back this up if you wish to see it. Please note that when the turnover from Alpine homes to the new Board occurred, all the filing documents and a corporate minutes book were handed over. They were never passed onto the present Board from the previous Board. We do have all the corporate financials though.<br /><br />• INCOME TAX We recently filed the Cove’s income taxes for past two years. We found this was never done. Even though we are a non-profit company and don’t have to pay taxes it is law that they still need to be filed. This was another example of why we fired Community Management, (which was run by a CPA, no less.)!<br /><br />• PROPERTY TAX We are also working on our property taxes for the Cove. We had never received any bills until now. It looks like the Assessor has these coded incorrectly as open land instead of exempt common area and we are working for a retroactive credit. This is a lot of work. We will update all owners promptly when this is resolved<br /><br />• GATE Please see Treasurer Amy if you need an extra gate remote or new phone number added to the call box, or if you even want your personal gate code changed. And by the way, Gene Marcum, our incredibly helpful neighbor is a professional metalworker and will be taking down our gates to sandblast and repaint them. He also added a new type of hinge to the walk-in gate to ensure it automatically closes. Thanks Gene!<br /><br />• ROADS We are doing some pavement patching in the next couple of weeks. We also replaced the broken grate near one of the mailboxes. That is not something you can just find at the mall but we managed to track down the right one for our private street.<br /><br />• TRASH Just a reminder per the CC&R’s the trash cans need to be kept out of view of the street. If you want an extra trash can please see Amy. The cost is $7.00 a month, which is what the Cove is billed by Ace.<br /><br />• LAWN SERVICE If you would like your backyard mowed, the cost is $12.00 per mow. Please see Amy and she will set it up through Prosecutive Landscaping.<br /><br />• CC&R’s & BYLAWS If you need a PDF file emailed, please see Amy or Robin.<br /><br />• RECEIVABLES Our current balance owed is $9,021.07. This makes it very hard to operate a HOA. We are going to have to crack down and find ways collect our money. The consequences will include cessation of trash and snow removal, as well as legal action for those who do not get current.<br /><br />• LIENS We currently have two home liens placed. If you continue your past due balance of more than 30 days then liens will be placed and collection actions taken which will affect credit reports.<br /><br />• SNOW As you may know with our last snow season came a pretty hefty bill we didn’t budget for. Past seasons we spent around $30,000 for snow removal. This year our snow was $10,000 more than that. However, “Hooray!” we just finished paying the last bill. We have also managed to stay current with lawn service. Even though we found ways to reduce costs in other areas we don’t have any extra money towards snow removal for this coming season. Let’s hope it is not a bad winter or we will have to make special assessments.<br /><br />• ACTIVITIES Please look in the SunCrest Newsletter coming out. The insurance company has already stated that the playground is fully covered and the rep told us that there were no specifications or restrictions. The City stated it is private property and akin to a backyard not requiring public specs. (If it were we would qualify for a 503c4 non profit and we are not. See Property Tax post.) <span class="blsp-spelling-error" id="SPELLING_ERROR_0">SunCrest</span> has also confirmed this. A certificate stating all details of this proposed insurance is supplied here, above.<br /><br /><br />BUDGET:<br />As several of you have asked, please note that a final budget has not yet been ascertained for the playground. The recent corner lot design has been <span class="blsp-spelling-corrected" id="SPELLING_ERROR_0">presented</span> for <span class="blsp-spelling-error" id="SPELLING_ERROR_1"><span class="blsp-spelling-error" id="SPELLING_ERROR_1">SunCrest</span></span> approval. At that time we will establish a firm budget depending on whether homeowners will be donating time and fence materials, trees, etc. <span class="blsp-spelling-corrected" id="SPELLING_ERROR_2">Nothing</span> is hidden, the <span class="blsp-spelling-error" id="SPELLING_ERROR_3"><span class="blsp-spelling-error" id="SPELLING_ERROR_2">playset</span></span> was $1601 including tax and from there we <span class="blsp-spelling-corrected" id="SPELLING_ERROR_4">will</span> see.<br /><br /><br />COSTS:<br />Thus far we have discussed that Darren would handle the dig for the mulch area, move the boulder, sprinkler adjustments, and pile the dirt for the berm. Volunteers can plant Aspen trees and plants that we get at <span class="blsp-spelling-error" id="SPELLING_ERROR_5"><span class="blsp-spelling-error" id="SPELLING_ERROR_3">WalMart</span></span> for $6 each. Volunteers may also be used to dig posts with a rented auger or shovels and cement the posts in place.<br /><br /><br />MORE DONATIONS = LESS WORK:<br />If the donations, all of which have not yet come in, are sufficient to have Darren handle all of the work so be it. Otherwise there are folks who look forward to volunteering.<br /><br /><br />GENERAL FUNDS:<br />Some funds can come from the general funds for a picnic table and some of the trees if needed as these are general improvements. Please stay tuned as the budget will be shared as soon as one is fully developed. $300 a year after we saved $1000 on insurance is still a good deal and is planned as a part of the homeowners fees.<br /><br /><br />OLDER KIDS:<br />Signs can be posted to prevent older kids from using. Older kids in our neighborhood are not interested in <span class="blsp-spelling-corrected" id="SPELLING_ERROR_6">playgrounds</span> anyway -- they like World of <span class="blsp-spelling-error" id="SPELLING_ERROR_7"><span class="blsp-spelling-error" id="SPELLING_ERROR_4">Warcraft</span></span> and X Box Live. If there is vandalism the insurance covers this. There will be picnic tables there and at the <span class="blsp-spelling-error" id="SPELLING_ERROR_5">pavillion</span> for folks of all ages -- teen and adults and children -- to congregate, and the proposed Aspen trees the play area will eventually provide dappled shade in the day.<br /><br /><br />SAFETY:<br />Lots of trees, raised berm with plantings, fence with corral gate, tables, and moms should deter kids from running out. Swings and slides aim to the sides where treed berm is, and there is 30 feet of distance to the curb, all blocked. A Caution sign at curve should deter speeders. We do have extremely low volume traffic. Currently the <span class="blsp-spelling-error" id="SPELLING_ERROR_6">Pavillion</span> where the children congregate is closer to the street than the proposed <span class="blsp-spelling-error" id="SPELLING_ERROR_7">playset</span> area. Furthermore the children walk on the sidewalks all the time. The waterfall is where they like to play now. The waterfall is more dangerous than a <span class="blsp-spelling-error" id="SPELLING_ERROR_8">playset</span> in every way yet we have not filled that in. A designated play area will give the children a safer and fun alternative. It would be an attractive and useful private Cove amenity.<br /><br /><br />CHANGE TO PLANS:<br /><strong><em><span style="color: rgb(255, 0, 0);">The concerns coming from the cutting of trees idea can be put to rest as that idea has been cancelled. The tape was merely to see the idea within the space. The vote about whether or not to cut trees is also cancelled</span></em>.</strong> It was all just up for discussion and nothing was being done. The Board met with the Design Review <span class="blsp-spelling-corrected" id="SPELLING_ERROR_8">July</span> 7<span class="blsp-spelling-error" id="SPELLING_ERROR_9"><span class="blsp-spelling-error" id="SPELLING_ERROR_9">th</span></span> evening to discuss the playground placement. Every possible location was considered with pros and cons weighed, the Board voted on the Corner Lot as the easiest spot. We were trying to answer the concerns about cutting trees and whether it was <span class="blsp-spelling-corrected" id="SPELLING_ERROR_10">appropriate</span> to even consider it. No secrets were kept and all will be presented at the meeting July 9<span class="blsp-spelling-error" id="SPELLING_ERROR_11"><span class="blsp-spelling-error" id="SPELLING_ERROR_10">th</span></span>. Meetings of the Design Board are not required to have homeowners present but those who were coincidentally there were shown all materials openly.<br /><br /><br />PURVIEW:<br />The maintenance and design of common areas is under the purview of the Neighborhood Design Review Board and the Board, and no homeowner vote is required for the Board to take action on the park.<br /><br /><br />EXISTING <span class="blsp-spelling-error" id="SPELLING_ERROR_11">SUNCREST</span> AMENITIES:<br />The <span class="blsp-spelling-error" id="SPELLING_ERROR_13"><span class="blsp-spelling-error" id="SPELLING_ERROR_12">SunCrest</span></span> playground is <span class="blsp-spelling-corrected" id="SPELLING_ERROR_14">across</span> a busy street, and is more for toddlers. A private amenity for the Cove is a plus for the neighborhood and superior to the "tot lot" at the Information Center and does not require leaving our private street, preferable to walking across Traverse Ridge Road.<br /><br /><br />NOT AN ADULTS ONLY COMMUNITY:<br />This is not a Retirement or Adults-Only community so those who oppose family-oriented amenities may wish to rethink their objections. Those with young families will enjoy this amenity and those who are retired may enjoy having their grandchildren play in our new playground.<br /><br /><br />PRIVATE YARDS:<br />No one yard is of a size or grade to accommodate a <span class="blsp-spelling-error" id="SPELLING_ERROR_15"><span class="blsp-spelling-error" id="SPELLING_ERROR_13">playset</span></span> of this <span class="blsp-spelling-corrected" id="SPELLING_ERROR_16">quality</span> or magnitude in this neighborhood. Pooled resources make for a great community.<br /><br /><br />SALE OF COMMON AREA<br />A homeowner had an interest and approached the Board about this however no action was taken, voted on or even considered except as informal discussion. If this were ever considered it would require a homeowner vote and 67% of the owners would have to agree. Any owner in arrears loses his vote which would reduce the number of votes required. It talked about the amount of property tax owed. Here are more details and information for those of you who would like to know what is being done.<br /><br />The Board has discovered that the previous Management Company never paid any of our property taxes. Combine that with the change to the county line from half Salt Lake County to All Utah County in 2006, incorrect addresses on file and there has been an accrual of $11,917.13 including all taxes and penalties.<br /><br />At the time of the handover in December 2005 to the HOA Alpine informed the new Board of this and documents were given. Alpine Homes had been paying the taxes before. The county line was changed and Managment Companies were changed and no one followed up. Community, our last Management Company is run by a CPA however among other improprieties this was not handled. Apparently, and unbeknownst to us, property tax is quite standard for common areas.<br /><br />All possible measures have been researched to avoid this: Filing a non-profit 501c3 or c4 exemption status are not options since we are neither a benvolent charitable group nor do we operate for the public good, only our own private owners. So we are indeed liable for property tax.<br /><br />Amy discovered the unpaid taxes after a small bill was forwarded to us by the first Management Company to Community who sent it to us long after we had fired them. This raised a red flag so we got to work. By going parcel by parcel through our plat maps Amy finally researched all the lots and Robin worked with the County Attorney and SunCrest to find out how to handle this.<br /><br />Some of the land is being taxed at an improper rate, that is, assessed as residential use when it is a steep slope, and so forth. So we have to first appeal all parcels to the Utah Tax Assessor to be rated differently and correctly at a lower rate. We must present photographic evidence and plat maps to prove our case. We also need to ask if this can be retroactively adjusted for this error.<br /><br />Once the tax basis is adjusted the appeal must then be made to the Utah Property Tax Attorney's office for a waiver of fees and penalties due to the breach of fiduciary by CPA who used to represent us, the previous Management Company and/or adjusted for change to tax basis.<br /><br />Once they have rendered a decision the amount remaining will need to be either set up on a long term payment plan which can come out of general operating funds or it will be specially asessed to all the homeowners as a one time assessment at the discretion of the Board.<br /><br />This Board is working to handle this matter promptly and will inform the owners a soon as resolution has been reached. Thanks for all your input!<br /><br />Here is a diagram of the new playground on the corner lot with the rock, that would be installed after SunCrest approval. It is out right now for their review. Paid for by a resident until we have donations to reimburse. The cost was $2000.00 and we had a $500 coupon we used. So the full cost including shipping and taxes was $1601.00.<br /><br />The yearly additional insurance costs will be $300.00 a year for the playground. Again remember we saved us $1000.00 year by switching our insurance company. This is the ONLY thing being paid by homeowner fees. I will contact the insurance company after holidays to get the actual coverages for you.<br /><br />Other costs depend on the communities input and help. We need the location prepared, what will be placed under the playground-grass, sand, bark, rubber bark. What kind of boarder to keep all that in.
